The ACLU on Thursday filed a lawsuit against Montana on behalf of several same-sex couples. The couples say the state denies them the same protections straight married couples receive in health care, end-of-life decision-making and inheritance.

A Missoula District Court judge on Monday confirmed Michelle Kulstad's custody rights to children she raised for years with a same-sex partner, who then sought sole custody when the relationship ended. “To discriminate further against Ms. Kulstad because of her sexual preference in this day and age is no different than telling a person to go to the back of the bus because of her skin color,” District Judge Ed McLean wrote. State University System excludes couples from partner benefits

A court ruling stated Montana's University System must provide benefits to domestic partners of its employees. Unfortunately, stringent restrictions require the couples to provide proof of partnership that many say are unreasonable. [link]
Montana Senate endorses limited rights to gay couples

The Senate approved legislation allowing residents to designate anyone, regardless of sexuality, as their next of kin. The bill also allows hospital visitation and authority to make medical decisions. The legislation now moves forward to the House. [link]
